Gandhi Dham

Gandhi Dham is a slum in Bijpur separated by boundary wall from NTPC Rihand Nagar Township. It is a locality developed as engineers started living in township. As engineers started living in township, they started giving job like sweeping, cleaning, washing clothes to the poor people. Traditional sweeper class (almost all of them belonged to DOM caste, the most downtrodden caste of Indian society) swarmed here and got regular job on meager wages. As they have no proper place to live and also they are not earning much without any hope for earning more in future, they temporarily made their home in the open place in the vicinity of NTPC. They used wood planks; tins etc for raising four walls and somehow covered their roof and started living. They also reared pigs as their traditional job. What is the most ironic situation for which they are own responsible is that they are not keeping their own home and locality clean. There are heaps wastages and collected water near their homes giving foul smell. Pigs are roaming here and there making the environment even worse.

Seeing their condition, I just interacted one sweeper who used to come in my room for cleaning. He started telling no one is helping them. I suggested him, but only you can change yourself. He understood my point. I suggested him to gather people, so I would address them. I reached in their locality on time. But there were none to receive me. Later I talked some other persons and they were also very confused. I again made them think that only they could change themselves. I again told them to gather people at some other time, so that we could address them for starting some educational program. Again no one turned. My friends became frustrated. I understood that if I wanted to change their life, then I myself had to go door to door for making them aware about better life.

My Observation:

Lack of confidence and hope for better life

Lack of cooperation

Unable to organize themselves in groups for implementing development work

Victims of many vices like drinking,

Having mindset that someone will come and distribute food, clothes etc. to them, but they themselves don’t want to put their own effort

No better schools for their children

Hardly any engineers interact with them. They are silent workers. They are coming, cleaning floors and went away without uttering a single world

They are treated badly by their contractor, they cut their salary on any small complaints

Ideas for their Improvement

Regular interaction and spread awareness about the importance of cleanliness in their own life and show them the vices of drinking, smoking etc. A small video, showing better family life, may work.

Provision for better school for their children with all academic facilities

Stressed on inculcating culture to their children

Provision for reserving some seats in schools like St. Joseph, DAV Public School running in township for better students and whose parents show some sign of improvement in their daily life. If these students got chance to stay with better students, they might start dreaming big in their life as well.

Provision for building a locality with better homes: This should be included in township planning. As the age of township (about 25 years) and the age of this locality (about 25 years) indicate that they are complementary and should be included in township planning.

Distribute better clothes to good students regularly (based on attendance in school)

Crux: the way of living and the living condition, opportunity for progress in life of working class has not changed at all in India. What could be its solution at policy level?

Social Inequality prevailing in Mithila

Some villagers of one of my senior were discussing with him about several aspects of marriage. That senior is proactive in social works and encourages all who want to pursue career in this field.
All were giving idea of making the event grand by spending huge money on dance program, lighting, food and many other things. I was sitting there and listened their ideas. Everything was decided by keeping in mind "what people will say". At last they also asked me about my opinion.
I told, "You should do what is correct. You should not plan keeping the opinion of people in mind. You are going to be great leader in future, you start giving a new thought to your people, even they oppose you."
I suggested that you should call people of all caste and make them eat together irrespective of caste prejudice. They all got shocked to hear this idea and told that they have to face the outrage of community. Brahmans will not sit with charmkar (Chamar) and eat socially.
Then we talked about humanity, importance of social equality. Boys got excited to listen these ideas and requested me to come their village to organize youth and promised that if not the old ones, but the youth will accept the doctrine of equality, and they will show complete faith in Bharatmata by seeing all as her beloved sons.
I was happy that at least these boys understood the logic. Hope in future people of all caste will sit together and eat together.

Reserved seat for scheduled caste in Panchayati Raj System: Some powerful people of higher caste helps in making a weak member of scheduled caste becoming Head of Village and become proxy decision makers of the village. Because of this there will not be any improvement in the status of schedule castes and ultimately that will deter the development of region and country and finally kill Indian culture. It is shame for Indian intellectuals that they are not learning anything from history. Social leaders have still great challenges to face.

Are we Indians?

Although our constitution, the most sacred book of modern India, spread secularism in the country. By birth we all are Indians belonging to any community, caste, creed or region. We all are supposed to be treated as Indian by law. But the new "communal law" under consideration is against the spirit of constitution for spreading unity and feeling of being Indian.

Because of this law, we become Hindus, Muslims, Biharis, Maharastrians etc first then only Indian or say we would never define ourselves as Indian.

It is true that there are some miscreants in Jammu-Kashmir killing innocent Pundits, there are some miscreats in Gujrat killing Hindus and Muslims, there are some miscreants in Maharashtra killing Biharis, but as a whole and in day-to-day walk we all felt the heat of brotherhood across the country BREAKING ALL THE SHACKLES.

This law will not protect minority, but it would turn into a great tool for miscreants spreading hatred and phobia among different communities. While working with any person, we all have to be very careful while treating keeping their lineage in mind.

Raise voice equivocally to stop this law getting implemented.

Narain's letter to Chief Justice JS Verma

Your Lordship,

I am approaching you with great pain and anguish. When in July 1993 I started investigating the Hawala case, all my well-wishers advised me not to take such a big risk. A risk of antagonising 115 most powerful people in the country. I was not at the fag end of my career, where it would not have mattered. My sons were only 4 and 9 years old. Unlike the celebrity crusaders, I did not have the backing of a media house, a corporate house or a political party. My fight was against the entire system. I don’t think there is a parallel of Hawala case, where both the ruling and opposition parties are involved in a single scandal. That is why nobody wanted to take it up. Yet I dared to challenge the might of those who claim to be controlling the destiny of this nation.

2. There are only a few people who at different stages helped me with their limited resources and abilities but nobody has written about them. Much later, when I filed the PIL, three co-petitioners were thrust upon me by Mr. Ram Jethmalani. They did not contribute positively. Rather their actions have been damaging to the cause. Mr. Jethmalani also played dirty tricks. He even attempted to give me a huge sum of money so that he could help the Jains and other accused. Failing to do so he changed sides. I was shocked to see his immoral behaviour and lust money at this stage.

4. Your Lordship, I knocked at the door of the Supreme Court in Oct. 1993 with the complaint : “ That some powers sitting in Dubai and London are funding the militancy in Kashmir and are also distributing money to the prominent politicians and bureaucrats. The money is coming through clandestine Hawala channels. CBI has all the information and sufficient evidence to investigate and prosecute these people but is shamelessly sitting over the matter since 3rd May 1991.” I wanted the Hon’ble Judges of the Apex Court to ensure that the CBI and other agencies perform their obligatory duties and arrest / prosecute the guilty under the relevant sections of TADA, POC, FERA, Income Tax and COFEPOSA.
The CBI blatantly, under the scrutiny of the Hon’ble Court, did not make use of the statements u/s 15 of TADA available with them thereby surrendering the presumptive evidence u/s 21 of TADA.
7. The Income Tax and the FERA authorities have also not moved an inch in this case, although huge amount of foreign currency were seized. Hence, the presumptive provisions of FERA being ignored with impunity.
10. Your Lordship, why can’t CBI’s ‘case file’ related to the Hawala case numbering 3/5(S)/91-SIU-V- parts I to V, 2/1(A)/95-ACU-VI and 3/1(A)95-ACU-VI-parts I to V along with all the volumes is being brought to the Apex Court. If examined properly these files will help in fixing the responsibility in one week’s time. So that all the guilty officials can instead be charge-sheeted for offences u/s 120B-IPC r/w 218-IPC and see 13(d) r/w 13(2) of the Prevention of Corruption Act for causing irreparable harm to the CBI. These officials have endangered the security of the nation by not doing their duty. Your Lordship! if the officials of other government departments would have done the same CBI sleuths would have arrested them by now. How can they be allowed to go scot-free for the same crime?
12. Your Lordship may I ask you, how is it that in the last 50 years not a single top politician or bureaucrat has been convicted for corruption? Although, corruption in India has crossed all limits of shame? Why Your Lordships why? We are under obligation to answer to the nation.

24. Once again I request you with folded hands, on behalf of millions of youth of this country please do not let this opportunity go out of our hands. Otherwise the future generations will not pardon us.

सांसदों को भी बुरा लगता हैं!

जब माननीय शरद यादवजी संसद में बोल रहे थे, तो उस समय मेरे साथ उन्हीं के विधानसभा क्षेत्र का एक साथी मेरे साथ था। शरद यादवजी के लिए मेरे मन में काफी आदरभाव था, लेकिन मेरे साथी ने बताया की उसे पता नहीं क्या कम किया हैं।
माननीय संसद महोदय अपने क्षेत्र के सरकारी विद्यालयों जहाँ के छात्र ठीक से पढ़ भी नहीं पाते तब आपको शर्म नहीं आती। आपके क्षेत्र में किसान भूख से मर जाते हैं, कर्ज में डूबकर आत्महत्या कर लेते फिर आपको शर्म क्यूँ नहीं आती।
आपके क्षेत्र में गरीब लोगों से भी जब सरकारी अस्पताल में फीस लिया जाता हैं फिर आप कहा सो रहे होते हैं।
क्या क्या लिख कर बताएँ यहाँ, जहाँ आपको ठेस लगनी चाहिए थी, लेकिन नहीं लगा।
दुखों से पीड़ित लोग तो भगवान् को भी कोसते हैं, न जाने क्या क्या कह जाते हैं, फिर आप तो सांसद हैं, धरती के भगवान्। यदि जनता आपको जली कटी सुना भी दिया तो उसको अपना मानहानि क्यूँ समझ रहे हैं, जनता के दर्द को समझिये, उसके लिए कुछ कीजिये। आपके तौहीन में तो जनता का खुद का तौहीन हैं।
इसलिए माननीय सांसद महोदय संसद भवन का अमूल्य समय न बर्बाद करते हुए, देश के विकास के महत्वपूर्ण विषयों पे ही विचार करें और जनता के दर्द को दूर करने का प्रयास करें, तो वहोई सम्मानीय व्यवहार होगा और समझदारी भी।
अभिनेता "ओमपुरी' के साथ मेरी सहानुभूति हैं और उनका जीवन गरीबों के लिए प्रेरणादाई।

अन्ना साहेब की जय हो

आखिर जनता की आवाज सुन ली गयी। गांधीजी का सपना था भारत का निर्माण संसद में बैठकर नहीं लोगों के बीच में कम करके होगा। अन्ना साहेब का जीवन दर्शन गांधीजी के उसी सिद्धांत को परिलक्षित करता हैं। वर्षों पहले गांधीजी के सिद्धांत पर चलने के लिए जयप्रकाश नारायण जी राजनीति से सन्यास लिया था और गौवों में मुसहरों की बस्ती में रहते हुए ग्राम सुधर का काम करते थे। उस समय भी संसद के तानाशाही को चुनौति भी एक लोक नेता ने ही दिया था।
जो भी युवा समाज निर्माण के कार्यों में लगना चाहते हैं, उनके लिए ये घटनाएँ निश्चितरूपैन प्रेरणादायी बलदायी रहेगा।
अन्ना की जीत, भारत की जीत हैं। आम जनता की जीत हैं। सबकी जीत हैं। संसद में बैठे लोगों की भी जीत हैं। संसद में बैठे लोग जनता की सेवा को ही अपना लक्ष्य साधे। इसी में देश की तरक्की हैं और भारत के चिरंतन संस्कृति की जीवन्तता बनी रहेगी।
जश्न का माहौल है। अपने तमाम शहीदों को नमन करें और राष्ट्र के विकास में प्राणपन से लगने के लिए कृत संकल्प हो।

अन्ना का मंच कोई नाट्य मंच नहीं

ऐसे आन्दोलनकारी माहौल में जब लोगों में देशभक्ति उमड़ रही हैं, इस तरह के बातों पे ध्यान खींचना ठीक न होगा। मगर अभिनेता 'ओमपुरी' के भाषण में जो शब्द प्रयोग किया वह अन्दर तक झकझोर दिया हैं ।
संसद में बैठे आधे नेता 'गवाँर' और 'अनपढ़' हैं, इसीलिए नेता लोग देश को बेच कर खा रहे हैं। 'गवाँर' व 'अनपढ़', ये दोनों शब्दों के इस तरह से प्रयोग भारत में रहने वाले ग्रामीण भाईओं व गौवों व कस्बों में रहने वाले लाखों लोग जो आर्थिक स्थिति ठीक न होने के कारन आधुनिक शिक्षा लेने में असमर्थ रहे, की तौहीन हैं। उनके प्रति इनलोगों का नजरिया बहुत बेकार हैं और शायद इन्हें देश के लोगों व संसद में बैठे लोगों के बारे में कुछ भी पता नहीं हैं।
आज देश में जितना संस्कार गॉव के लोगों में हैं (गाँधीजी ने भी अपने ज़माने में यही बात लिखा था), आज मानवीय मूल्यों के प्रति जितनी श्रद्धा मूर्खों में हैं, उतना आप शहरों में या पढ़े लिखे वर्ग में यदा कदा ही देख पाएंगे। कलमाड़ी साहब मुर्ख हैं? राजा साहब मुर्ख हैं? सभी नेताओं के बारे में नहीं पता लेकिन शीर्ष के नेताओं में कितने मुर्ख हैं?
आज के भ्रष्ट नेता व अधिकारी क्या मुर्ख हैं? भारतीय प्रोद्योगिकी संस्थान जो देश का सर्वोच्च शिक्षा संस्थान मन जाता हैं और हैं भी के कितने छात्रों का जीवन समाज के सामान्य लोगों के द्वारा अनुकरणीय हैं? कितने पढ़े लिखे छात्र खेती बरी कर सकते हैं या करना चाहते हैं, जबकि भोजन सबको चाहिए और इसलिए किसान के बिना समाज की कल्पना भी नहीं की जा सकती। आज सामान्य जनों में सत्य, ईमानदारी आदि मूल्यों के प्रति आस्था किन लोगों के कारण कम हुईं हैं ? क्या पढ़ा लिखा वर्ग अपने आप समाज की बुराइयों जैसे जाति-प्रथा, दहेज़ इत्यादि से अपने को अलग कर पाया हैं?
मुझे लगता हैं वास्तव में आज की शिक्षा-प्रणाली लोगों को शिक्षित बनाने के बजाय मुर्ख ही बना रही हैं। अतः इस प्रणाली में आमूल-चुल परिवर्तन की आवश्यकता हैं।
आज देश के सबसे बड़े नेता, हम उन्हें तीसरा गाँधी (जयप्रकाश नारायण दुसरे गाँधी मने गए थे) भी बोल सकते हैं, उनका पढाई में क्या योग्यता हैं? क्या वे गॉव से नहीं हैं?
नेताओं का चयन समाज के द्वारा होना चाहिए। उनकी शिक्षा समाज में सामाजिक कार्यों के द्वारा ही हो सकती हैं। गरीबों का दर्द व उनके मनोभाव उनके साथ एक लम्बे समय तक रहने पर ही हो सकती हैं, किसी किताब को पढ़ के नहीं। हा ये लोगो का कर्त्तव्य होना चाहिए की वे किसी भी व्यक्ति के व्यक्तित्व व उसके आम समाज के सान्निध्य को देखते हुए अपना मत दे न कि किसी पार्टी के नाम पर। राहुल गाँधी का प्रधान मंत्री बनने कि चर्चा भी इस देश में प्रजातंत्र का गला घोंटना ही हैं।
मंच का उपयोग समाज जिन प्रश्नों से जूझ रहा, संसदीय प्रणाली के किन कमियों के कारण वे समस्याएँ हैं और उन्हें किस तरह से दूर किया जाय, इसी पर विचार किया जाय। इसमें भारतीय जनता के चरित्र का ख्याल भी हों। भीड़ मेंटलिटी को कैसे श्थायित्व प्रदान किया जाय उसपे भी विचार हों। इसके लिए अन्ना-दल को देश के सुदूर प्रदेशों में कम कर रहें लोगो को मंच पे स्थान देना चाहिए, वे गरीब लोगों कि समस्याओं का वर्णन मार्मिक ढंग से कर सकेंगे और आन्दोलन को एक सुनियोजित स्वरुप देंगे। यह आन्दोलन कानून के साथ साथ लोगों को एक नया जीवन दर्शन दे इसके लिए प्रयास करना चाहिए। आम चुनाव कि तरह आम पार्टियों कि तरह अभिनेताओं का भाषण नहीं चाहिए। आज तो देशभक्ति कि ऐसी धूम मची हैं कि नेता, अभिनेता, क्रिक्केटर सभी फीके पद गया हैं, आज केवल अन्ना का त्यागपूर्ण जीवन ही लोगों को उद्वेलित कर रहा हैं। समाज में त्याग कर रहे लोगों के लिए यह निश्चित ही सम्मानीय विषय हैं।

The government miscalculated by aggressively targeting the Gandhian with accusations of corruption and then arrested him and sent to Tihar Jail, fuelling anger and escalating hostilities। While the Centre has blamed the court for the Tihar order, Congress MPs are now punching holes in the theory, saying that the so called magistrate was a Delhi Police ACP-rank officer who acted as quasi-judicial authority, indicating that he would not have moved without orders from the top.

For now, whatever questions you may have about the Jan Lokpal Bill, here are the answers you're likely to get: tick the box — (a) Vande Mataram (b) Bharat Mata ki Jai (c) India is Anna, Anna is India (d) Jai Hind।
For completely different reasons, and in completely different ways, you could say that the Maoists and the Jan Lokpal Bill have one thing in common — they both seek the overthrow of the Indian State। One working from the bottom up, by means of an armed struggle, waged by a largely adivasi army, made up of the poorest of the poor. The other, from the top down, by means of a bloodless Gandhian coup, led by a freshly minted saint, and an army of largely urban, and certainly better off people. (In this one, the Government collaborates by doing everything it possibly can to overthrow itself.)
Team Anna whizzed in and out of the high security prison, carrying out his video messages, to be broadcast on national TV on all channels। (Which other person would be granted this luxury?) Meanwhile 250 employees of the Municipal Commission of Delhi, 15 trucks, and six earth movers worked around the clock to ready the slushy Ramlila grounds for the grand weekend spectacle. Now, waited upon hand and foot, watched over by chanting crowds and crane-mounted cameras, attended to by India's most expensive doctors, the third phase of Anna's fast to the death has begun. “From Kashmir to Kanyakumari, India is One,” the TV anchors tell us.
While his means may be Gandhian, Anna Hazare's demands are certainly not। Contrary to Gandhiji's ideas about the decentralisation of power, the Jan Lokpal Bill is a draconian, anti-corruption law, in which a panel of carefully chosen people will administer a giant bureaucracy, with thousands of employees, with the power to police everybody from the Prime Minister, the judiciary, members of Parliament, and all of the bureaucracy, down to the lowest government official. The Lokpal will have the powers of investigation, surveillance, and prosecution. Except for the fact that it won't have its own prisons, it will function as an independent administration, meant to counter the bloated, unaccountable, corrupt one that we already have. Two oligarchies, instead of just one.
Imagine, for example, a city of shopping malls, on whose streets hawking has been banned। A hawker pays the local beat cop and the man from the municipality a small bribe to break the law and sell her wares to those who cannot afford the prices in the malls. Is that such a terrible thing? In future will she have to pay the Lokpal representative too? Does the solution to the problems faced by ordinary people lie in addressing the structural inequality, or in creating yet another power structure that people will have to defer to?
The Fast' of course doesn't mean Irom Sharmila's fast that has lasted for more than ten years (she's being force fed now) against the AFSPA, which allows soldiers in Manipur to kill merely on suspicion। It does not mean the relay hunger fast that is going on right now by ten thousand villagers in Koodankulam protesting against the nuclear power plant. ‘The People' does not mean the Manipuris who support Irom Sharmila's fast. Nor does it mean the thousands who are facing down armed policemen and mining mafias in Jagatsinghpur, or Kalinganagar, or Niyamgiri, or Bastar, or Jaitapur. Nor do we mean the victims of the Bhopal gas leak, or the people displaced by dams in the Narmada Valley. Nor do we mean the farmers in NOIDA, or Pune or Haryana or elsewhere in the country, resisting the takeover of the land.
The People' only means the audience that has gathered to watch the spectacle of a 74-year-old man threatening to starve himself to death if his Jan Lokpal Bill is not tabled and passed by Parliament। ‘The People' are the tens of thousands who have been miraculously multiplied into millions by our TV channels, like Christ multiplied the fishes and loaves to feed the hungry. “A billion voices have spoken,” we're told. “India is Anna.”
Who is he really, this new saint, this Voice of the People? Oddly enough we've heard him say nothing about things of urgent concern। Nothing about the farmer's suicides in his neighbourhood, or about Operation Green Hunt further away. Nothing about Singur, Nandigram, Lalgarh, nothing about Posco, about farmer's agitations or the blight of SEZs. He doesn't seem to have a view about the Government's plans to deploy the Indian Army in the forests of Central India.
He does however support Raj Thackeray's Marathi Manoos xenophobia and has praised the ‘development model' of Gujarat's Chief Minister who oversaw the 2002 pogrom against Muslims। (Anna withdrew that statement after a public outcry, but presumably not his admiration.)
Mukul Sharma who has studied Anna's village community in Ralegan Siddhi, where there have been no Gram Panchayat or Co-operative society elections in the last 25 years। We know about Anna's attitude to ‘harijans': “It was Mahatma Gandhi's vision that every village should have one chamar, one sunar, one kumhar and so on. They should all do their work according to their role and occupation, and in this way, a village will be self-dependant. This is what we are practicing in Ralegan Siddhi.” Is it surprising that members of Team Anna have also been associated with Youth for Equality, the anti-reservation (pro-“merit”) movement? The campaign is being handled by people who run a clutch of generously funded NGOs whose donors include Coca-Cola and the Lehman Brothers. Kabir, run by Arvind Kejriwal and Manish Sisodia, key figures in Team Anna, has received $400,000 from the Ford Foundation in the last three years. Among contributors to the India Against Corruption campaign there are Indian companies and foundations that own aluminum plants, build ports and SEZs, and run Real Estate businesses and are closely connected to politicians who run financial empires that run into thousands of crores of rupees. Some of them are currently being investigated for corruption and other crimes. Why are they all so enthusiastic?
At a time when the State is withdrawing from its traditional duties and Corporations and NGOs are taking over government functions (water supply, electricity, transport, telecommunication, mining, health, education); at a time when the terrifying power and reach of the corporate owned media is trying to control the public imagination, one would think that these institutions — the corporations, the media, and NGOs — would be included in the jurisdiction of a Lokpal bill। Instead, the proposed bill leaves them out completely.

लोक पाल बिल

It is in this context that this article addresses the issue of whether the Prime Minister should be brought under the ambit of an Ombudsman (Lokpal) and be subject to its scrutiny। It is important to observe that in most of the Lokpal bills, including the 2010 government draft (except the 1985 version), the Prime Minister is within the ambit of the Lokpal.
Under the Indian Constitution there is no provision to give immunity to the Prime Minister, Chief Ministers or Ministers। Under Article 361, immunity from criminal proceedings is conferred on the President and the Governor (formerly the Rajpramukh) only “during his term of office.”
During the period of the Internal Emergency (1975-77), Indira Gandhi enjoyed dictatorial powers। She detained without trial prominent Opposition leaders and was supported by a captive and rump Parliament.
The Constitution (Fortieth Amendment) Bill was moved in, and passed by, the Rajya Sabha in August 1975 and later it was to go before the Lok Sabha। The Bill was blacked out from the media and hence very few people knew about it. It never became law because it was not moved in the Lok Sabha.
The Bill sought to amend Article 361 by substituting sub-clause (2) thus: “(2) No criminal proceedings whatsoever, against or concerning a person who is or has been the President or the Prime Minister or the Governor of a State, shall lie in any court, or shall be instituted or continued in any court in respect of any act done by him, whether before he entered upon his office or during his term of office as President or Prime Minister or Governor of a State, as the case may be, and no process whatsoever including process for arrest or imprisonment shall issue from any court against such person in respect of any such act।”
In Japan, Prime Minister Kakuei Tanaka (July 1972 to December 1974) was found guilty of bribery and sentenced। In Israel, Prime Minister Ehud Olmert was indicted in corruption scandals in August 2009. In Italy, Prime Minister Silvio Berlusconi enacted, through a pliant legislature, a law by which he shielded himself from prosecution. The Italian Constitutional Court recently invalidated crucial parts of that law, which may result in his trial being revived.
The first one runs thus: “The simple answer is, if the Prime Minister is covered under ordinary law (the Prevention of Corruption Act), you don't need him covered under Lokpal.” This is a view that has been attributed to the former Chief Justice of India, J.S. Verma (Hindustan Times, June 27, 2011). Any misconduct by a Prime Minister can be investigated by the Central Bureau of Investigation: this view is that of Chief Minister Jayalalithaa (The Hindu, June 28, 2011). This objection concedes the principle that the Prime Minister is not immune from criminal liability and can be investigated, but argues and assumes that the Prevention of Corruption Act and the CBI present effective existing alternative procedures. Nothing could be farther from the truth and the ground realities.





What is the ground reality? First, the CBI, the premier anti-corruption investigative agency, is under the Department of Personnel and Training, which is controlled by the Prime Minister's Office (PMO)। Secondly, the career prospects of CBI officers and other personnel are dependent on the political executive, and all officers are subject to transfer except the Director. Thus, the investigative arm is controlled by the ‘political suspects' themselves. Thirdly, the Single Directive, a secret administrative directive that was invalidated by the Supreme Court in the Jain hawala case in 1997 (Vineet Narain v. Union of India) has been legislatively revived. Consequently, under Section 6A of the Delhi Special Police Establishment Act, the CBI is disabled from starting an inquiry or investigation against Joint Secretary or higher level bureaucrats without the Central government's prior approval. Therefore, the Prevention of Corruption Act is a non-starter against Ministers and high-level bureaucrats who may act in concert. It is imperative that the CBI's anti-corruption wing be brought under the Lokpal and not under the PMO. This alone would meet the test of an independent and fearless investigative agency as enunciated by Justice Krishna Iyer.






Secondly, it is argued that if the Prime Minister is within its ambit, the Lokpal could be used by foreign powers to destabilise the government। Today, the checks on the executive government are the higher judiciary, which has actively intervened in the 2G spectrum scam and other scams; the CAG, whose reports against the functioning of the telecommunications sector triggered investigations into scams; the Election Commission headed by the Chief Election Commissioner, which conducted elections in West Bengal in the most efficient and orderly fashion. All these authorities could be undermined by a foreign power. Why should the Lokpal alone be the target of a foreign power? Why not the intelligence and defence services? Why not leaks from Cabinet Ministers and their offices — bugged or not?






Thirdly, it is argued that bringing the Prime Minister under the Lokpal's scrutiny would mean a parallel government being put in place। This objection is disingenuous. Do the Supreme Court and the higher judiciary constitute a parallel government? Is the CAG a parallel government? Is the CEC a parallel government? Is the CBI a parallel government? The answer is clear. These constitute checks and restraints on the political executive and the administration so that public funds are not misappropriated and constitutional democracy and citizen rights are not subverted. The Lokpal will be under the Constitution and subject to judicial review, and it is imperative that the anti-corruption wing of the CBI be brought under the Lokpal. There is no question of any parallel government. The Lokpal will be only a check on the corrupt activities of the Executive. If all checks and balances are to be regarded as the marks of a parallel government and therefore abolished, it will be a recipe for dictatorship.

The Lokpal bill was first introduced by Shanti Bhushan in 1968[5] and passed in the 4th Lok Sabha in 1969. But it did not get through in the Rajya Sabha, the upper house of the Parliament of India. Subsequent versions were re-introduced in 1971, 1977, 1985, 1989, 1996, 1998, 2001, 2005 and in 2008,[10] but none of them passed. The bill is inspired of setting up an independent commission like Independent Commission Against Corruption (Hong Kong) (ICAG).[
Renewed calls for the bill arose over resentment of the major differences between the draft 2010 Lokpal Bill prepared by the government and that prepared by the members of the associated activists movement — N. Santosh Hegde, a former justice of the Supreme Court of India; Lokayukta of Karnataka; Shanti Bhushan; Arvind Kejriwal; Prashant Bhushan, a senior lawyer in the Supreme Court; and members of the India Against Corruption movement[2]
Key features of proposed bill
Some important features of the proposed bill are:[2]
To establish a central government anti-corruption institution called Lokpal, supported by Lokayukta at the state level.
As in the case of the Supreme Court and Cabinet Secretariat, the Lokpal will be supervised by the Cabinet Secretary and the Election Commission. As a result, it will be completely independent of the government and free from ministerial influence in its investigations.
Members will be appointed by judges, Indian Administrative Service officers with a clean record, private citizens and constitutional authorities through a transparent and participatory process.
A selection committee will invite short-listed candidates for interviews, videorecordings of which will thereafter be made public.
Every month on its website, the Lokayukta will publish a list of cases dealt with, brief details of each, their outcome and any action taken or proposed. It will also publish lists of all cases received by the Lokayukta during the previous month, cases dealt with and those which are pending.
Investigations of each case must be completed in one year. Any resulting trials should be concluded in the following year, giving a total maximum process time of two years.
Losses caused to the government by a corrupt individual will be recovered at the time of conviction.
Government officework required by a citizen that is not completed within a prescribed time period will result in Lokpal imposing financial penalties on those responsible, which will then be given as compensation to the complainant.
Complaints against any officer of Lokpal will be investigated and completed within a month and, if found to be substantive, will result in the officer being dismissed within two months.
The existing anti-corruption agencies (CVC, departmental vigilance and the anti-corruption branch of the CBI) will be merged into Lokpal which will have complete power and authority to independently investigate and prosecute any officer, judge or politician.
Whistleblowers who alert the agency to potential corruption cases will also be provided with protection by it।

देशभक्त बटुकेश्वर दत्त एक महान क्रांतिकारी

बटुकेश्वर दत्त (नवंबर १९०८ - १९ जुलाई १९६५) भारतके स्वतंत्रता संग्रामके महान क्रांतिकारी थे । स्वतंत्रता सेनानी बटुकेश्वर दत्त सर्वप्रथम ८ अप्रैल, १९२९ को राष्ट्रसे परिचित हुए, जब वे भगत सिंहके साथ केंद्रीय विधान सभामें बम विस्फोटके पश्चात् बंदी बनाए गए ।

जन्म

बटुकेश्वर दत्तका जन्म १८ नवम्बर, १९१० को बंगाली कायस्थ परिवारमें ग्राम-औरी, जिला नानी बेदवानमें (बंगालमें) हुआ था; परंतु पिता ‘गोष्ठ बिहारी दत्त' कानपुरमें नौकरी करते थे । बटुकेश्वरने १९२५ में मैट्रिककी परीक्षा पास की और तभी माता एवं पिता दोनोंका देहांत हो गया । इसी समय वे सरदार भगतसिंह और चंद्रशेखर आजादके संपर्कमें आए और क्रान्तिकारी संगठन ‘हिन्दुस्तान सोशलिस्ट रिपब्लिकन एसोसियेशन’के सदस्य बन गए । सुखदेव और राजगुरुके साथ भी उन्होंने विभिन्न स्थानों पर काम किया । इसी क्रममें बम बनाना भी सीखा ।

क्रांतिकारी जीवन

८ अप्रैल, १९२९ को दिल्ली स्थित केंद्रीय विधानसभामें (वर्तमान का संसद भवन) भगत सिंहके साथ बम विस्फोट कर ब्रिटिश राज्यकी अधिनायकताका विरोध किया । बम विस्फोट बिना किसीको हानी पहुंचाए केवल पर्चोंके माध्यमसे अपनी बातको प्रचारित करनेके लिए किया गया था । उस दिन भारतीय स्वतंत्रता सेनानियोंको दबानेके लिए ब्रिटिश शासनकी ओरसे पब्लिक सेफ्टी बिल और ट्रेड डिस्प्यूट बिल लाया गया था, जो इन लोगोंके विरोधके कारण एक वोटसे पारित नहीं हो पाया ।

कारागृह जीवन

इस घटनाके पश्चात् बटुकेश्वर दत्त और भगत सिंहको बंदी बनाया गया । १२ जून, १९२९ को इन दोनोंको आजीवन कारावासका दंड सुनाया गया । दंड सुनानेके उपरांत इनको लाहौर फोर्ट कारागृहमें भेजा गया । यहां पर भगत सिंह और बटुकेश्वर दत्त पर लाहौर षडयंत्र अभियोग चलाया गया । उल्लेखनीय है कि साइमन कमीशनका विरोध- प्रदर्शन करते हुए लाहौरमें लाला लाजपत रायको अंग्रेजोंके आदेशपर अंग्रेजी राजके सिपाहियों द्वारा इतना पीटा गया कि उनकी मृत्यु हो गई । अंग्रेजी राजके उत्तरदायी पुलिस अधिकारीको मारकर इस मृत्युका प्रतिशोध चुकानेका निर्णय क्रांतिकारियों द्वारा लिया गया था ।

इस कार्यवाहीके परिणामस्वरूप लाहौर षडयंत्र अभियोग चला, जिसमें भगत सिंह, राजगुरु और सुखदेवको फांसी दी गई थी । बटुकेश्वर दत्तको आजीवन कारावास काटनेके लिए काला पानी भेज दिया गया । कारागृहमें ही उन्होंने १९३३ और १९३७ में ऐतिहासिक भूख हडताल की । सेल्यूलर कारागृहसे १९३७ में बांकीपुर केंद्रीय कारागृह, पटनामें लाए गए और १९३८ में मुक्त कर दिए गए । काला पानीसे गंभीर बीमारी लेकर लौटे दत्त पुनः बंदी बनाए गए और चार वर्षोंके पश्चात् १९४५ में मुक्त किए गए ।

बटुकेश्वर दत्त : जिन्हें स्वतंत्रताके उपरांत मिली केवल उपेक्षा

देशकी स्वतंत्रताके लिए अनंत दुःख झेलने वाले क्रांतिकारी एवं स्वतंत्रता सेनानी बटुकेश्वर दत्तका जीवन भारतकी स्वतंत्रताके उपरांत भी दंश, यातनाओं, और संघर्षोंकी गाथा बना रहा और उन्हें वह सम्मान नहीं मिल पाया जिसके वह अधिकारी थे । उन्होंने बिस्कुट और डबलरोटीका एक छोटासा उद्योगालय (कारखाना) खोला; परंतु उसमें बहुत हानि उठानी पडी और वह बंद करना पडा । कुछ समय तक यात्री (टूरिस्ट) प्रतिनिधि एवं बस परिवहनका काम भी किया; परंतु एक के पश्चात् एक कामोंमें असफलता ही उनके हाथ लगी ।

दत्तके जीवनके इस अज्ञात अंगका सारांश नेशनल बुक ट्रस्ट द्वारा प्रकाशित पुस्तक (बटुकेश्वर दत्त, भगत सिंहके सहयोगी) में हुआ है । अनिल वर्मा द्वारा लिखी गयी यह संभवत: पहली ऐसी पुस्तक है, जो उनके जीवनका प्रामाणिक संलेख (दस्तावेज) होनेके साथ-साथ स्वतंत्रता संघर्ष और स्वतंत्रताके पश्चात जीवन संघर्षको उजागर करती है ।

बीमारीमें उपेक्षाके शिकार बटुकेश्वर दत्त :

बटुकेश्वर दत्तके १९६४ में अचानक व्याधिग्रस्त होनेके पश्चात् उन्हें गंभीर स्थितिमें पटनाके शासकीय चिकित्सालयमें भर्ती कराया गया । इस पर उनके मित्र चमनलाल आजादने एक लेखमें लिखा, ‘क्या दत्त जैसे कांतिकारीको भारतमें जन्म लेना चाहिए, परमात्माने इतने महान शूरवीरको हमारे देशमें जन्म देकर भारी भूल की है । खेदकी बात है कि जिस व्यक्तिने देशको स्वतंत्र करानेके लिए प्राणोंकी चिंता नहीं की और जो फांसीसे बाल-बाल बच गया, वह आज नितांत दयनीय स्थितिमें चिकित्सालयमें पडा एडियां रगड रहा है और उसे कोई पूछनेवाला तक नहीं है ।’

इसके पश्चात सत्ताके गलियारोंमें हडकंप मच गया और चमनलाल आजाद, केंद्रीय गृहमंत्री गुलजारी लाल नंदा और पंजाबके मंत्री भीमलाल सच्चरसे मिले । पंजाब शासनने एक सहस्र रुपएका धनादेश बिहार शासनको भेजकर वहांके मुख्यमंत्री के. बी. सहायको लिखा कि यदि वे उनका वैद्यकीय उपचार करानेमें सक्षम नहीं हैं तो वह उनका दिल्ली अथवा चंडीगढमें वैद्यकीय उपचारका व्यय वहन करने को तत्पर हैं ।

बिहार शासनकी उदासीनता और उपेक्षाके कारण क्रांतिकारी बैकुंठनाथ शुक्ला पटनाके शासकीय चिकित्सालयमें असमय ही प्राण छोड चुके थे । अत: बिहार शासन क्रियाशील हो गयी और पटना वैद्यकीय महाविद्यालयमें (मेडिकल कॉलेज) डॉ. मुखोपाध्यायने दत्तका उपचार चालू किया; परंतु उनकी स्थिति बिगडती गयी; क्योंकि उन्हें सही उपचार नहीं मिल पाया था और २२ नवंबर १९६४ को उन्हें दिल्ली लाया गया ।

दिल्ली पहुंचने पर उन्होंने पत्रकारोंसे कहा था, मैने स्वप्नमें भी नहीं सोचा था कि, मैं उस दिल्लीमें जहां मैने बम डाला था, एक अपाहिज बनकर स्ट्रेचर पर लाया जाऊंगा । उन्हें सफदरजंग चिकित्सालयमें भर्ती किया गया । पीठमें असहनीय पीडाके उपचारमें लिए किए जाने वाले कोबाल्ट ट्रीटमेंटकी व्यवस्था केवल एम्समें थी; परंतु वहां भी कमरा मिलनेमें विलंब हुआ । २३ नवंबरको पहली बार उन्हें कोबाल्ट ट्रीटमेंट दिया गया और ११ दिसंबरको उन्हें एम्समें भर्ती किया गया ।

तदनंतर पता चला कि, दत्त बाबूको कैंसर है और उनके जीवनके चंद दिन ही शेष बचे हैं । भीषण पीडा झेल रहे दत्त अपने मुखपर वह पीडा कभी भी न आने देते थे । पंजाबके मुख्यमंत्री रामकिशन जब दत्तसे मिलने पहुंचे और उन्होंने पूछ लिया, हम आपको कुछ देना चाहते हैं, जो भी आपकी इच्छा हो मांग लीजिए । छलछलाए नेत्र और मंदस्मितके साथ उन्होंने कहा, हमें कुछ नहीं चाहिए । बस मेरी यही अंतिम इच्छा है कि, मेरा दाह संस्कार मेरे मित्र भगत सिंहकी समाधिके पासमें किया जाए ।

जीवनके अंतिम क्षण:

लाहौर षडयंत्र अभियोगके किशोरीलाल अंतिम व्यक्ति थे, जिन्हें उन्होंने पहचाना था । उनकी बिगडती स्थिति देखकर भगत सिंह की मां विद्यावतीको पंजाबसे कारसे बुलाया गया । १७ जुलाईको वह कोमामें चले गये और २० जुलाई १९६५ की रात एक बजकर ५० मिनट पर दत्त बाबू इस संसारसे विदा हो गये । उनका अंतिम संस्कार उनकी इच्छाके अनुसार, भारत-पाक सीमाके पास हुसैनीवालामें भगत सिंह, राजगुरू और सुखदेवकी समाधिके निकट किया गया ।

Role of society

Should society take law in their hand? All were excited to see the punishment given to the gundas of local town by police and then similar course followed by people mob for other street goons in Ajay Devagan starred movie Gangajal.
After seeing the seemingly uncontrolled nature of tyranny one may get induced to take the extreme step. Momentarily the action could be justified, but it would be deadly for society in long run.
Recently in my home town mob killed two robbers, captured the rest and prisoned them. People took such step after risking their life and they fulfilled their purpose. They also captured police who came in the morning to inspect the scene. Later agitation caused the suspension of some police officials.
Society has to introspect before abusing others. Except the mob like moment people used to sleep in their home giving little care to the daily affairs of society. People should work day and night for building the characters of common people and future generation.
Who will punish people for their inactivity?

Hinduism Vs Islam-phobia

Strengthening Hinduism should be taken in positive way which is needed to purge Hindu society. Hinduism is not a negative thought, but it is a positive force to propel humans for attaining divinity. This teaches oneness among humans. Because of historical reasons and the aggressive nature of some misguided member of Islam, people start taking Hinduism in wrong way. They think this idea will protect them from Islam. Some even argues that segregation of Islam will cure all problems and Hindus will live happily. Hinduism is not a force to separate people, but it is a powerful thought to unite humans amid intense diversity.
Hinduism ignites mind. It propels a person to fight with himself. One has to fight this battle to win and control one’s own mind which is needed for achieving divinity and blessing of happiness. By nature this doesn’t come automatically, but there is a process for achieving that divinity. If more people start practicing Hinduism, it will automatically get strengthened and people will get conducive environment for living purposely.
Not Islam, not Christianity or not any other power has capability to kill or eliminate Hinduism, but only Hindu will kill Hinduism. When selfishness clouds our mind, when dishonesty, insensitiveness towards fellow humans, lack of service, wrong food habits and many such vices become our part of life Hinduism dies.
As religion, Christianity, Islam and Hinduism are not different. In the core all are same. But is the political force behind all these religion which is threat to society. Instead of fighting this evil power, people thought separation of people following all these religion will solve the problem. Pakistan was created. The condition of Pakistani Mussalman became even worse than the condition of Mussalman in India who progressed in life as Hindus do. The Hindus and others in Pakistan have no voice which was other failure of that system.
The greatest task for Hindus is to propel Hindus to follow austerity in their daily life. Once they will follow such path, others will automatically accept that goodness and will incorporate in their own lives. This will send good message to foreigners, who will also start accepting these thoughts and hence humanity will win on diverse nature of different religion. All will go on the path of devotion from their own means and Bharat will automatically prosper.
Hindu first follow Hinduism, Islam follow Islam and Christian follow Christianity that is the way of life. If one wants divinity, happiness then although they follow different religion then can marry and can attain all those things living in same room but following different path. Not separation but togetherness will solve the problem.

My Dear Pai





He called me today morning and told "Shanta sir me going home." As usual I asked him "When will you come back dear? I will soon come to meet you people""Oh no sir, I am finally going home. I am not going to come back again." Suddenly I realized his posting has already been decided. Although we have spent very few days together, but we have developed very deep emotional bond with each other. Whenever I used to go there (Shakti Nagar), he used to stay with me always. While sitting in his room, he kept listening me without telling a word. The moment I had stop
ped, he started asking questions clarifies his own daily affairs.

Although he spoke little to me, he always liked to show me all the activities he had done in very silent manner. Once I told him about my coming at Shakti Nagar, he with his friend went in the Basti earlier and colled all children to come definitely. Whenever I told him I am going to arrange for my sleep somewhere, he used to insist me to sleep in his room. He always felt awkward to see his room's pathetic condition in my presence and tried to arrange that properly. During winter he directed the heaters towards me and went to his friends' for sleep without getting noticed.

Why do we people come to meet and develop emotional attachment? Sometimes I think I born in a small village in northern Bihar and he took birth at the tip of southern India in Karnataka, but I always felt more affectionate with him than my own villagers. Why? There is no answer of all these questions. The truth is that he has gone and only his memories and his cares for children who changed my course of career and for whom I was anxious for one whole year.

He likes Vivekanand's thought deeply and wishes to become teacher in future to teach children the idea of India. Best of luck my Dear friend! You will always have a space in my heart.

I do remember your outburst for telling the story of India to the children of Sewa Kunj. (India was not discovered by Vasco da Gama, but always existed before than any human records.)

Ignorant IITians

The development of social structure is very complex phenomena. Many forces are consistently working for giving it a new shape, a new direction. Unfortunately these forces are not always good for humans or a particular community. As the process is very slow, the impact is observed in many advanced stage which sometimes becomes incorrigible.

The wise person of a particular community are supposed to keep eyes on such development and project its implications on the society in long term. After understanding the problem well, he is supposed to aware the common mass and take necessary steps.

But it was unfortunate that wise men of India are very ignorant about many issues. One such burning issue is the problem of conversion. A conscious mind is supposed to take his own path for fulfilling his goal. But problem is common mass follows things just for immediate gain. They can not be categorized as persons acting consciously. The problem arises because of conversion of these lot of common masses. I will write the problem of conversion in detail later. Today I just want to high light that even IITian who are considered as the brightest breed in India could be ignorant about social structures.

While talking on the issues of conversion I found that my senior from IIT doesn't know that Hindus are staying in Pakistan, leave the status, social and economical condition of those fellow brother who are treated as secondary citizen in their own homeland. Historically Pakistan was the land of Hindus, but because of ignorance our ancestors these people have to live there as secondary citizens.

What is more unfortunate that, that particular person is very caste conscious. As a girl in his community refused to marry him and chosen a boy from other community, he gave a great deal about the distinct culture and tradition of that particular caste. How fool could an IITian be? We have to raise question about our education system, which rate a person on his capability of earning or making money rather contributing significantly on building his own society.
